Official Notice: Membership Status Review and Good Standing Requirement
February 22, 2026
Dear Valued BFAA Member:
This correspondence constitutes formal notice regarding your membership status with the Black Farmers and Agriculturalists Association (BFAA).
BFAA remains engaged in federal litigation seeking relief for its members, particularly those who were denied the opportunity to file legacy claims on behalf of deceased loved ones pursuant to Section 22007 of the Inflation Reduction Act of 2012.
The United States Department of Agriculture (USDA) excluded legacy claims (deceased victims of discrimination) from participation, asserting that Congress did not intend such claims to be covered under the Act. However, as a result of this exclusion affecting our members, BFAA initiated litigation in the Federal Courts. The matter has progressed and is now being prepared for submission to the United States Supreme Court.
The Petition for Writ of Certiorari must be filed on or before March 8, 2026.
Therefore, in preparation for this filing, BFAA is conducting a final review of its membership records to confirm which individuals are members in good standing (associational standing) as of the filing deadline.
According to our records, your membership may not be current.
PLEASE TAKE NOTICE:
This notice is being provided to ensure that you are afforded a clear and documented opportunity to review and, if necessary, renew your membership prior to the Court filing.
A copy of the membership application is enclosed/attached for your convenience.
If your membership is already current, please disregard this notice and accept our appreciation for your continued support.
